DOT-regulated employers are required to (1) provide employees with a copy of the company’s substance abuse policy; (2) provide employee educational materials; and (3) to obtain and file a signed receipt for the policy and educational materials regarding the negative consequences of substance abuse. All of these materials are included in the Drug Screens Plus Model Programs…personalized for your company and ready to copy for distribution to employees.
Some states (and employers subject to collective bargaining) may have similar requirements. The Drug Screens Plus (non-DOT) Drug Free Workplace Program includes employee policy and educational materials (and employee receipt forms).
Whether or not required by fed/state regulations, it is a good idea to provide employees with these materials. As a bonus, providing the materials and getting a signed receipt precludes the “nobody told me” defense, and decision makers in W/C, unemployment, union arbitration (and/or other actions taken on behalf of the employee), may require proof that the employer has provided such information to the employee.
